Hui “New Year 2023” Giveaway Contest

OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR TO WIN. VOID WHERE PROHIBITED.

The Hui “New Year 2023” Giveaway Contest is in no way sponsored, endorsed, administered by, or associated with Facebook or Instagram.

ELIGIBILITY. Subject to the additional restrictions below, Hui Car Share^*’s Hui “New Year 2023” Giveaway Contest (the “Contest”) is open to legal residents of the State of Hawaii who are 19 years of age or older at the time of entry, unless local law prohibits entry or requires pre-registration or bonding. Employees of Hui Car Share and its subsidiaries, (“Sponsor”), its parent company (Servco Pacific Inc.), or any of their affiliates, subsidiaries, or advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees are not eligible to enter or to win. The term “immediate family members” includes spouses, parents, grandparents, siblings, children, and grandchildren.

HOW TO ENTER. The Contest entry period lasts for seven (7) days which begins on Wednesday, January 25 at 12:00 AM HST and ends on Wednesday, February 1 at 11:59 PM HST (the “Contest Period”) and involves the entry method described below.

The Contest will be administered by Hui Car Share as the Sponsor. To enter the Contest for a chance to win, visit the Hui Car Share Facebook page (Facebook.com/DriveHui) during the Contest Period noted above, and “Like” the page, as well post a comment to the post and tag a friend.

Alternately, on Instagram you may “Follow” @drivehui, as well as publish a comment to the post and tag a friend.

In entering the Contest in this manner, you are hereby granting Hui Car Share the use of your photos in its marketing, including in its social media posts and on its website.

Additionally, to qualify for entry, your Facebook and/or Instagram account must have a method with which the Sponsor may contact you (e.g., Facebook Direct Message, Instagram Direct Message), in the event you are selected as a winner.

WINNER SELECTION. On or around Thursday, February 2, 2023, Hui Car Share will select five (5) Prize Winners among all eligible entries received during the Contest Period. Selection will be done at random.

PRIZES AND ODDS. The Prize Winner selected in the Contest will receive a prize package and $50.00 in Hui driving credits.

The odds of winning depend on the number of eligible entries received during the Contest Period.

WINNER NOTIFICATION AND PRIZE ACCEPTANCE. The Prize Winner will be notified either via a reply to the comment he/she posted as an entry, or via Facebook or Instagram Direct Message. Award of the prizes is subject to verification of the Winner’s eligibility and compliance with these Official Rules. Sponsor’s inability to reach a Winner by post comments and/or via Direct Message, and/or a Winner’s failure to timely respond to prize notification, and/or a Winner’s failure to comply with any term or condition of these Official Rules may, at the sole discretion of Sponsor, result in that Winner’s disqualification, the forfeiture of his/her interest in all prizes and the selection of a substitute Winner from among all remaining eligible entries. Winner may waive his/her right to receive prizes. Prizes are nonassignable and nontransferable. No substitutions allowed by Winner. Prizes are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winner is solely responsible for reporting and payment of any taxes on prizes. The Prize Winner may be required to complete an affidavit of eligibility and a liability and publicity release (except where prohibited by law), both of which must be returned within ten (10) days of the date of personal delivery or sender’s postmark. Failure to sign and return the affidavit and release within ten (10) days may result in the Prize Winner’s disqualification, the forfeiture of his/her interest in the Prize, and the award of the Prize to a substitute Winner.

CONDITIONS OF PARTICIPATION. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor and the Contest judges designated by Sponsor. Except where prohibited, participation in the Contest constitutes each entrant’s consent to the Sponsor’s publication of the entrant’s name, biographical information, voice recording and likeness in any media for any commercial or promotional purpose, without limitation or further compensation. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest, or any portion thereof. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award the prizes based on the entries received before the termination date. Sponsor will not be responsible for incomplete, lost, late, misdirected or illegible entries, for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, telephone equipment, line or network, whether originating with sender, a third-party provider, or Sponsor. Third party merchants and service providers are solely responsible for the quality and performance of any goods and/or services awarded as part of the prizes. Any rules of said merchants relating to the redemption, return, exchange, and/or expiration of such awards shall apply. Sponsor is not responsible for those portions of the prizes provided by such third-party merchants. Sponsor shall not be liable for any bodily harm and/or property damage and/or lost opportunity which may result from this Contest or for the provision of the goods or services awarded as prizes. All personal information collected by the Sponsor will be used for administration of this drawing. In addition, entrants may receive email correspondence from, or on behalf of Hui Car Share subject to our privacy policy. Hui Car Share uses reasonable commercial efforts to comply with Federal CAN-SPAM guidelines, and entrants may subsequently opt-out of receiving further emails by following opt-out instructions contained in any such email.

GENERAL RELEASE. By entering the Contest, entrants release the Sponsor, its respective parent companies, affiliates, subsidiaries, and advertising and promotional agencies, and its officers, directors, employees, agents and representatives from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injury, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

CONSTRUCTION. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and Sponsor, shall be governed by, and construed in accordance with the laws of the State of Hawaii, without giving effect to any choice of law or conflict of law rules or provisions (whether of Hawaii, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Hawaii. In the event that any dispute arises regarding the meaning or interpretation of these Official Rules, participants agree that the dispute shall be by and within the courts of the State of Hawaii and no other. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

SPONSOR. The Contest is sponsored by Hui Car Share and its subsidiaries, whose decisions regarding the selection of winners and all other aspects of the Contest will be final and binding in all respects.

^*”Hui Car Share”, “our”, “we” or “us” means Servco Mobility Lab, LLC, a Delaware limited liability company, and its successors and assigns.
